§ 1 Scope and Provider
These Terms and Conditions apply to all orders placed through the online shop imperfectly-perfect.shop.

Only these Terms and Conditions apply. Deviating terms of the customer are not recognised unless the provider expressly agrees to them in writing.
§ 2 Conclusion of Contract
The display of products in the online shop does not constitute a legally binding offer but a non-binding invitation for the customer to order goods.
By submitting your order through our checkout process (Stripe), you submit a binding purchase offer. Acceptance of the offer is made by confirmation of the order via email (order confirmation).
The contract text is stored by us. You will receive the contract confirmation by email. The contract language is English or German.
§ 3 Prices and Taxes
All prices are final prices in Euros (EUR) and include the IGIC (Impuesto General Indirecto Canario) applicable in the Canary Islands. The Canary Islands are not part of the EU VAT territory — therefore no EU VAT applies.
Notice for customers in mainland EU and other countries: Import VAT and customs duties may apply when importing to mainland EU or other countries. These costs are borne by the buyer. The exact amounts depend on the destination country and goods value.
Shipping costs are shown separately and are visible before completing the order. Shipping is free for orders over 100 € (within supported shipping zones).
§ 4 Payment
Payment processing is handled by the payment service provider Stripe. The following payment methods are available:

- SEPA Direct Debit
- Klarna
Payment is due upon completion of the order. We do not store any credit card data — all payment processing is handled by Stripe.
§ 5 Delivery and Shipping
Shipping is from the Canary Islands (El Médano, Tenerife, Spain). The estimated delivery time is usually 5–7 business days within the EU. Delivery times outside the EU may vary.
For custom orders and made-to-order items, individual production times apply and will be communicated in advance.
Pick-up in El Médano is possible by prior arrangement.
§ 6 One-of-a-Kind Products
All products are handmade originals. Each piece exists only once. Minor variations in shape, colour, size or pattern compared to product photos are possible and part of the handmade nature. Such variations do not constitute a defect.
§ 7 Right of Withdrawal
Consumers have a statutory right of withdrawal of 14 days. For individually manufactured products (custom orders), the right of withdrawal is excluded after customer approval. The full withdrawal instructions and model withdrawal form can be found at: Withdrawal Policy.
§ 8 Warranty
Statutory warranty rights apply. The warranty period is two years from receipt of the goods. Minor variations in handmade products (see § 6) do not constitute a warranty claim.
§ 9 Liability
The provider is liable without limitation for intent and gross negligence. For simple negligence, the provider is only liable in the event of breach of essential contractual obligations (cardinal obligations), limited to foreseeable, typically occurring damage. These limitations of liability do not apply to damages arising from injury to life, body or health.
§ 10 Retention of Title
The delivered goods remain the property of the provider until full payment has been received.
§ 11 Applicable Law and Jurisdiction
The law of the Kingdom of Spain applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a consumer, the mandatory consumer protection law of the state in which the customer has their habitual residence also applies, insofar as it is more favourable.
The place of jurisdiction for all disputes is, to the extent legally permissible, the registered office of the provider (Tenerife, Spain). For consumers, the statutory place of jurisdiction applies.
§ 12 Dispute Resolution
The European Commission provides a platform for online dispute resolution:

We are neither obliged nor willing to participate in dispute resolution proceedings before a
consumer arbitration body.
§ 13 Severability Clause
Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
